Faltando horas para el cierre de la legislatura ordinaria, prevista para mañana, la Cámara de Diputados arrancó ayer martes sus trabajos legislativos en sesiones, luego de los días feriados, con intensas jornadas laborales. Entre otros asuntos, aprobó en primera lectura el proyecto de ley de Fideicomiso Público, convirtió en ley otros tres proyectos y sancionó de forma favorable un préstamo.

Precisamente este martes, con el rechazo de los diputados de los Partidos de la Liberación Dominicana (PLD) y de la Fuerza del Pueblo y tras intensos debates, la Cámara de Diputados aprobó en primera lectura y con modificaciones el proyecto de ley de Fideicomiso Público.  La pieza fue aprobada con 103 votos a favor, 61 en contra y hubo cinco abstenciones.

El pleno acogió el informe favorable, con modificaciones, de la comisión especial, presidida por el diputado Francisco J. Paulino. El documento fue firmado por nueve diputados y  otros 10, integrantes de seis partidos de oposición, no lo rubricaron. Se trata de los miembros de los partidos de la Liberación Dominicana (PLD), Fuerza del Pueblo (FP), Revolucionario Dominicano (PRD), Reformista Social Cristiano (PRSC), Alianza País y Frente Amplio.

Comisionados consultados por Diario Libre explicaron que durante la última reunión de la comisión especial aprobaron el informe con la mayoría de los votos de los diputados presentes por lo cual dicho informe era válido.

“Los principios”

Entre las decisiones tomadas por la comisión especial, que según el informe favorable, fueron aprobadas en tan solo cinco minutos, figuran el cuestionado artículo 14 de la pieza al que le fue eliminada la frase “los principios”, agregada el pasado 25 de mayo en el pleno del Senado.

La pieza reza que los procesos para la selección de proveedores, la adjudicación de contratos para realizar obras, la prestación de servicios, adquisición de bienes con cargo al patrimonio fideicomitivo, y las demás actuaciones del fideicomiso público, se harán “de conformidad a la Ley No. 340-06 sobre Compras y Contrataciones Públicas, Obras y Concesiones y sus modificaciones”.

Se mantiene el párrafo del artículo 14 que establece que cada fideicomiso público deberá elaborar un reglamento interno de contrataciones que contendrá los requerimientos y estándares internacionales necesarios para contratar bienes y servicios. El reglamento deberá ser aprobado por la Dirección General de Contrataciones Públicas.

Además, consigna en el artículo 6 que la constitución de todo fideicomiso público deberá estar precedida por un decreto, sin el cual, no tendrá validez.

El párrafo I, del artículo 6, fue modificado y establece que los fideicomisos públicos que contengan disposiciones relativas a la afectación de las rentas nacionales, a la enajenación de bienes del Estado, al levantamiento de empréstitos o cuando estipulen exenciones de impuestos en general, estarán sujetos a la aprobación del Congreso Nacional. Se le añadió a lo anterior es “según lo que establece el artículo 128, numeral 2), literal d) de la Constitución”.

A la pieza se le quitó lo aprobado en el Senado que establecía que se incluían los citados escenarios y que “en los demás casos la conformación del patrimonio fideicomitivo se efectuará mediante la entrega o la transferencia del derecho objeto de la operación, según lo establezca el acto constitutivo del fideicomiso”.

Fue añadido el artículo 7: “La constitución de todo fideicomiso público correspondiente a los demás poderes y órganos extra poderes del Estado deberán ser aprobados por el Congreso Nacional. Otro cambio es el consignado en el artículo 11, párrafo II, de que el Consejo Técnico deberá estar integrado por mayoría de funcionarios públicos.

Aprobación y debates

Los debates fueron extensos y desde el litoral oficial, los diputados Francisco Paulino y José -Bertico- Santana defendieron el proyecto de ley. Paulino aseguró que los bienes del Estado no serán privatizados.

Una llamada de parte del comité político del PLD habría hecho cambiar la posición de ese partido opositor, que en principio, a través del vocero de ese bloque, Juan Julio Campos, dio a conocer que apoyarían la pieza.

Diputados del PLD y de la FP argumentaron que favorecían aprobar la normativa pero que persistían aspectos importantes que debían ser modificados.

Previo a la sesión ordinaria, Servio Tulio Castaños Guzmán, vicepresidente ejecutivo de la Fundación Institucionalidad y Justicia (Finjus), se reunió con Alfredo Pacheco, presidente de la Cámara de Diputados, y manifestó su respaldo a la pieza. Dijo que no hay que desconfiar de que todo lo que se haga desde el Estado sea con intención maligna.

Tres leyes y un préstamo

También, la Cámara Baja convirtió en Ley tres proyectos; el primero autoriza al Ejecutivo, a través del Ministerio de Hacienda, a emitir y colocar valores de deuda pública por hasta un monto máximo de más de 363.2 millones de pesos o su equivalente en moneda extranjera. La pieza fue declarada de urgencia y aprobada en dos lecturas.

Además, los diputados convirtieron en Ley los proyectos de Comercio Marítimo y sobre Recurso de Casación. Asimismo, sancionaron un préstamo por 100 millones de dólares para financiar el Programa de Apoyo a la Consolidación de un Sistema de Protección Social Inclusivo, que será ejecutado por la Dirección General del Programa Supérate.

Para hoy y mañana la Cámara de Diputados tiene previsto sesionar en procura de aprobar varias iniciativas antes de que concluya la actual legislatura ordinaria el próximo jueves.

FP y PLD advierten es inconstitucional la aprobación

Los voceros de las bancadas opositoras de los partidos Fuerza del Pueblo y de la Liberación Dominicana coincidieron en el rechazo a la aprobación en primera lectura del proyecto de ley de Fideicomiso Público por considerar que se ha querido decir que la ley es ordinaria cuando en realidad es orgánica. Omar Fernández, portavoz de la FP, dijo que el PRM no tiene los votos para lograr pasar este proyecto que con una aprobación más en la Cámara Baja sería convertido en ley por parte del Congreso Nacional y pasaría de manera expresa al Poder Ejecutivo para su observación o promulgación.

“Cuando involucra enajenación de bienes del Estado y operaciones financieras es porque es una ley orgánica, pero nos han querido vender que es una ley ordinaria”, refirió Omar Fernández.

Lamentó que las sanciones contenidas en esta ley cuando se comenten actos fraudulentos graves son de 100 o 200 salarios mínimos cuando se habla de miles millones del Estado. Manifestó que el camino que les quedaría si es aprobado en segunda lectura es llevar el caso al Tribunal Constitucional.“El PLD no está en contra de este proyecto desde el punto de vista del fondo, pero no en la manera en que fue aprobado, porque con relación al informe de la comisión en muchos aspectos no estábamos de acuerdo y con relación a la manera en que se aprobó el proyecto siendo esta una ley orgánica establecida en los artículos 128 numeral 2  literal D de la Constitución y en el artículo 112 que establece que las leyes orgánicas deben ser aprobadas con las dos terceras partes de manera taxativa como lo estable la ley sustantiva de la nación”, indicó el portavoz de la bancada opositora, Juan Julio Campos. La sugerencia del partido morado y amarillo en ese sentido es que el proyecto vuelva a comisión. Niguna de las dos organizaciones se oponen al proyecto, pero quieren sea estudiado.
