El Poder Ejecutivo promulgó el reglamento general de aplicación para la nueva Ley de Aduanas 168-21, que regulará y garantizará la correcta aplicación de dicha ley.

De acuerdo con informaciones, con la publicación de esta ordenanza se actualiza la legislación nacional, al adoptar buenas prácticas internacionales como lo han hecho otras regiones del mundo.

Asimismo, el país operará bajo la luz de directrices de organismos internacionales en el ámbito aduanero y el comercio internacional, como la Organización Mundial de Aduanas (OMA), y la Organización Mundial del Comercio (OMC).

El director general de Aduanas, Eduardo Sanz Lovatón, afirmó que este nuevo marco regulatorio impulsará los planes de República Dominicana de convertirse en el hub logístico más importante de la región de las Américas.

“Esta nueva ley y su reglamento nos permitirán colocarnos entre los países de mayor transparencia y eficiencia en las operaciones y actividades de comercio exterior, lo que nos colocará entre las aduanas más competitivas e innovadoras de la región”, expresó Sanz Lovatón.

La normativa fue promovida por la Dirección General de Aduanas (DGA) y agotó un proceso de consultas y consensos entre los legisladores, sectores Públicos y Privados, en particular con gremios empresariales, gremios de profesionales relacionados con la actividad aduanera y de comercio exterior.

También, participaron transportistas y representantes de estos sectores, así como todas las partes interesadas que mostraron interés tanto en la ley como en el reglamento, así como, con los técnicos y asesores de la institución y la Consultoría Jurídica del Poder Ejecutivo.

La entidad recaudadora destacó que este reglamento general que hoy se publica, no tiene carácter exclusivo, debido a que el Poder Ejecutivo dictará los reglamentos específicos que se estimen necesarios para complementar la ley y esta ordenanza.

Novedades

Dentro de los aspectos regulados en este reglamento se encuentran los relativos a las Facultades de control y fiscalización de la Aduana; La entrada y salida de medios de transporte y mercancías. Así como también, el Proceso de despacho aduanero; Régimen Tributario Aduanero, y el Régimen y Procedimiento Administrativo Sancionador.

Pendientes

Quedan pendiente por reglamentar: los Regímenes Aduaneros Especiales; Operadores Aduaneros; Modalidades de cobros; Operaciones aduaneras, aspectos que serán reglamentados con el mismo proceso de transparencia y consentimiento entre los sectores Público y Privado.

Se recuerda que la nueva Ley de Aduanas 168-21, fue promulgada el pasado 25 de agosto de 2021, sustituyendo a un texto jurídico de más de 68 años de antigüedad.

Vistas públicas

Cada aspecto a regular, así como la forma en que se hizo, fue planteado a los principales gremios empresariales e industriales del país, mediante un proceso de vistas públicas.

Durante ese proceso, fueron identificados 257 artículos con observaciones, los cuales fueron revisados de manera pormenorizada con todas y cada una de las consideraciones vertidas, logrando ser acogidas e implementadas el 51.6 %, aceptadas e incorporadas en el texto reglamentario.

Esta labor, ininterrumpida, conllevó más de 132 horas de trabajo de revisión, divididas en 33 reuniones internas.
