El Ministerio de Trabajo informó ayer que una vez tenga la sentencia íntegra del Tribunal Constitucional que declara inconstitucional la Resolución 14-2022 sobre el trabajo doméstico, emitirá su opinión al respecto.
En un comunicado para la prensa, Trabajo informa que estudiará la sentencia e informará su parecer, “acorde al respeto del Estado de Derecho y de los órganos constitucionales”.
“Como Ministerio de Trabajo, al velar por la protección de los derechos de todos los trabajadores, respetamos el ordenamiento jurídico nacional e internacional, y siempre sustentaremos nuestras actuaciones en el respeto de las normas establecidas y el más alto interés de abordar los retos laborales de la vida nacional desde el consenso entre los dominicanos”, explica el comunicado.
El Tribunal Constitucional anuló la resolución número 14-2022, “sobre adopción y armonización de medidas atinentes al mejoramiento del cumplimiento del Convenio 189 de la Organización Internacional del Trabajo (OIT)”, emitida por el Ministerio de Trabajo el 25 de agosto de 2022 para regular el oficio de las trabajadoras domésticas.
El Constitucional acogió una acción de inconstitucionalidad interpuesta contra la resolución por el abogado Luis Vilchez Bournigal.
La resolución 14-2022 establece que ambas partes (empleador y empleado) determinarán las horas en las que las trabajadoras domésticas presentarán sus servicios, quedando estipulado de manera clara en el contrato de trabajo, incluido los descansos dentro de la jornada que preste el trabajador en un mismo día.
Además de que los trabajadores y trabajadoras deberán tener un descanso de 36 horas a la semana, de acuerdo con los términos del contrato.
Indica que el salario de los trabajadores domésticos sea preferiblemente pagado en efectivo, en la fecha acordada por las partes, en periodos que nunca serán mayores a un mes de labores.
El pago podrá efectuarse a través de cualquier medio legal, siempre y cuando sea con el consentimiento del trabajador.
