El superintendente de Bancos, Alejandro Fernández W. manifestó su apoyo a las iniciativas legislativas que buscan fortalecer el marco jurídico dominicano para la persecución y sanción de los delitos financieros, especialmente aquellos que involucran la captación irregular de recursos de ciudadanos incautos o menos informados.

En ello coincidieron los juristas y expertos que participaron en el Seminario sobre delitos financieros 2023, organizado por la Superintendencia de Bancos (SB) y realizado en el Pabellón de

la Fama del Deporte Dominicano.

“Este anteproyecto surge a causa de las pocas herramientas para perseguir estos actos y de la gran cantidad de personas que se aprovechan de la vulnerabilidad de sus víctimas”, expresó la senadora del Distrito Nacional, Faride Raful, al referirse a la pieza legislativa que presentó ante el

Congreso Nacional y que tiene como objetivo establecer consecuencias penales para quienes se dediquen a captar recursos del público sin la debida autorización de la Junta Monetaria o la supervisión de la SB.

Robustas herramientas

El jurista Carlos Salcedo, uno de los redactores del anteproyecto de ley, manifestó que este instrumento jurídico pretende proveer otras y más robustas herramientas para perseguir y reprimir a quienes captan recursos de manera irregular a través de estructuras piramidales y tipo Ponzi con la promesa de ganancias prontas y desmesuradas.

A juicio de Salcedo es necesario mejorar, revitalizar, actualizar y ampliar la legislación vigente en el país para poder combatir con sanciones penales la intermediación financiera no autorizada más allá de las meras sanciones administrativas».

El abogado José Lorenzo Fermín explicó que la evolución de la sociedad y la economía ha traído consigo el surgimiento de nuevas realidades y actores. Por lo cual, la regulación del Estado debe responder a estos nuevos escenarios.

Ministerio Público

Karina Concepción Medina, procuradora fiscal que dirige la Dirección Nacional de Investigación contra Delitos Financieros del Ministerio Público, aseguró que desde el Ministerio Público se trabaja para dar respuesta a la sociedad ante la ocurrencia de infracciones que podrían

surgir de esquemas piramidales.

Mencionó como ejemplo los esfuerzos llevados a cabo junto a la

SB para fortalecer la Dirección Nacional de Investigaciones de Delitos Financieros a raíz de la suscripción del acuerdo de colaboración entre ambas instituciones.

Evolución

El abogado Julio Camejo expresó que el país ha pasado por un proceso de evolución para ir fortaleciendo su regulación en materia de combate de los delitos económicos y financieros. Así las cosas, expresó que “esto se ha logrado gracias a la adecuación normativa a las particularidades y nuevos escenarios”.

Como discurso de cierre de la actividad, Luz Marte, consultora jurídica de la SB, reiteró el compromiso de la institución con las labores de persecución de los delitos financieros y agradeció el aporte de los expositores al debate, así como la presencia de los más de 250 profesionales del derecho que se dieron cita en el evento.
