Al quedar demostrada la responsabilidad penal, de manos de la fiscal Zayra Soto, de Litigación Definitiva, un tribunal condenó a 10 años de prisión al ex pelotero de Grandes Ligas Eugenio Vélez y un su hermano, Algenis Vélez de la Rosa, encontrados culpables de tráfico ilegal de armas de fuego.
La sentencia fue dictada por el Primer Tribunal Colegiado provincia Santo Domingo.
El condenado es Eugenio Vélez Vancomper, ex torpedero de Grandes Ligas de 40 años de edad, domiciliado en la calle Emilio Sánchez, próximo al complejo deportiva del sector Villa Olímpica, en San Pedro de Macorís.
También, fue condenado a 10 años de prisión, Algenis Vélez de la Rosa, de 42 años de edad, hermano del ex pelotero de Grandes Ligas y domiciliado en la misma dirección.
El tribunal encontró a los dos justiciables culpables en lo ilícitos de Asociación de Malhechores, además de Porte, Tenencia y Traficó ilegal de armas de fuego.
De acuerdo a la acusación, luego de una labor de inteligencia, el ex pelotero Eugenio Vélez y su hermano, fueron arrestados la tarde del cuatro de marzo del 2020, en el carro Mercedes Benz del Grande Liga, donde se ocupó un arsenal de armas ilegales, entre ellas un rifle calibre 5.6 milímetros, M15, dos cargadores y 34 cápsulas.
Posteriormente al arresto, se practicó un allanamiento a la residencia de Eugenio Vélez, donde fue ocupada un pistola marca Waltler, modelo P22, calibre 22 mm, con su cargador y seis capsulas, sin ningún permiso legal.
El pelotero de Grandes Ligas y su hermano, fueron sometidos a la justicia acusados de pertenecer a una red criminal que se dedicaba a comprar, comercializar y distribuir de manera ilegal, armas de fuego en el territorio de República Dominicana.
El 14 de marzo del 2020, el juez Bernardo Coplín García, de la Oficina Judicial de Servicios de Atención Permanente de Santo Domingo Este, le impuso a los dos encartados, prisión preventiva como medida de coerción, mediante la Resolución Penal número 530-2020-SMEC-00615.
En el juicio de fondo, realizado este jueves ocho de diciembre, el tribunal compuesto por Elizabeth E. Rodríguez Espinal (presidente), Julio A. Aybar Ortiz y Flor E. Batista Polo (miembros) , encontró a los dos justiciable culpables de Asociación de Malhechores y Trafico y Comercio Ilegal de Armas de fuego.
Esto en violación de los Artículos 66, 67, 68, 70, 71 y 72 de la Ley 631-16, para el Control, Regulación de Armas, Municiones y Materiales Relacionados y los Artículos 265 y 266 del Código Penal Dominicano.
El fiscal Héctor Manuel Romero Pérez, director técnico de la Procuraduría Fiscal de Santo Domingo Este, estuvo a su cargo la investigación y formulación de acusación a los justiciables.
El tribunal impuso a los condenados el pago de una multa de 20 salarios mínimos y el pago de las Costas Penales del proceso.
